These Terms of Service apply to your use of the Ummah Balance website and to orders placed through our online store.

By using our website or placing an order, you agree to these Terms together with the policies referred to below. Please read them carefully before placing an order.

Our Privacy Policy explains how we process personal information. Our Returns & Refunds Policy and Shipping Policy provide further information about cancellations, returns, refunds, production and delivery.

Who we are

This website is operated by Ummah Balance Limited. Throughout the website, “we”, “us” and “our” refer to Ummah Balance Limited.

Ummah Balance is an online Islamic lifestyle brand selling clothing and related products within the United Kingdom.

Use of our website

You may use our website only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the website.

You must not misuse the website by introducing viruses, malware or harmful code, attempting to gain unauthorised access to our systems or data, or interfering with the website’s security or operation.

We may suspend or restrict access to the website where we reasonably believe these Terms have been breached or where this is necessary to protect the website, our customers or our systems.

Eligibility to purchase

By placing an order, you confirm that you are legally capable of entering into a contract and that the information you provide is accurate and complete.

If you are under 18, you should place an order only with the involvement and permission of a parent or guardian.

Products

We aim to describe and display our products accurately. Goods supplied by us must be as described, of satisfactory quality and fit for any purpose made known to us, in accordance with your statutory rights.

Product photographs and mock-ups are used to present the design and garment. Colours may appear slightly different depending on screen settings, lighting and photography. Minor variations in print positioning, garment measurements and appearance may also occur because of the garment size and production process.

These reasonable variations do not affect your rights if a product is faulty, materially different from its description or otherwise fails to meet the standards required by law.

We may update product descriptions, images, prices, specifications and availability. Changes will not affect an order that we have already accepted, except where we contact you to correct an error and you agree to proceed.

We may discontinue products at any time.

Made-to-order products

Most Ummah Balance products are produced after an order is placed through our print-on-demand fulfilment partner. This helps reduce unnecessary waste and allows us to offer our designs without holding large quantities of stock.

Being produced after an order is placed does not remove your statutory cancellation rights for our standard catalogue products, including pre-designed garments offered in the sizes and colours shown on our website.

If we offer an item that is genuinely personalised or made to an individual customer’s specifications, the statutory right to cancel may not apply. Any such exception will be clearly explained before you place the order.

Placing an order

When you submit an order, you are making an offer to purchase the products in your basket.

An automated order acknowledgement confirms that we have received your order. It does not necessarily mean that we have accepted it.

A contract between you and Ummah Balance Limited is formed when we send confirmation that your order has been accepted or dispatched, whichever occurs first.

We may refuse or cancel an order before acceptance where reasonably necessary, including where:

  • A product is unavailable
  • Product information, pricing or availability contains an error
  • Payment is declined or cannot be verified
  • We reasonably suspect fraud, misuse or unauthorised activity
  • The order cannot be produced or delivered
  • The order details are incomplete or materially incorrect
  • The delivery address is outside the areas we serve
  • We reasonably believe the order is being placed for unauthorised resale

If we cancel an order after taking payment, we will refund the amount paid for the cancelled products and any related delivery charge.

Cancelling an order

You may cancel most online orders without giving a reason. Your statutory cancellation rights are explained fully in our Returns & Refunds Policy.

You may notify us that you wish to cancel at any time after placing the order and up to 14 days after the day on which the goods are delivered.

If you contact us before dispatch, we will try to stop the order. If production or dispatch cannot be stopped, you may need to receive the item and return it using the instructions we provide.

Nothing in this section limits any rights you have under UK consumer law.

UK orders only

We currently accept orders for delivery only within the United Kingdom.

Orders placed for delivery outside the United Kingdom may be refused or cancelled. We will update our website and policies if our delivery areas change.

Pricing and payment

Prices are shown in pounds sterling. Any delivery charges will be displayed before you submit your order.

We may update prices at any time. Price changes will not affect orders that have already been accepted, except where there is an obvious and unmistakable pricing error that could reasonably have been recognised as a mistake.

If we identify a pricing error before accepting an order, we may contact you to ask whether you wish to proceed at the correct price or cancel the order.

Payment must be made using one of the payment methods available at checkout. Payments are processed by third-party payment providers. We do not receive or store your complete payment-card details on our own systems.

Delivery

Most products require production time before dispatch. Estimated production and delivery times are shown on our website and in our Shipping Policy.

We will deliver orders without undue delay and within the timeframe agreed with you. Unless a different delivery period has been agreed, goods will normally be delivered no later than 30 days after the contract is formed.

Delivery estimates are not guaranteed dates unless we have expressly agreed otherwise.

We are responsible for the goods until they are delivered to you, or to another person you have nominated to receive them. This does not apply where you independently arrange a carrier that we did not offer as a delivery option.

Please provide a complete and accurate delivery address. If an order is delayed, returned or requires redelivery because the address supplied was incorrect or incomplete, we may ask you to pay reasonable additional delivery costs.

This does not remove our responsibility for loss, damage or delivery failures caused by us or by a delivery service selected by us.

Returns and refunds

Cancellations, returns, refunds and product problems are handled in accordance with our Returns & Refunds Policy.

Please contact us before returning an item so that we can provide the correct return address and instructions.

Your right to cancel or return an order does not depend on us approving your request. Contacting us first helps ensure that the item is sent to the correct address.

For change-of-mind returns, you will normally be responsible for the return-postage cost where we informed you of this before purchase.

If the whole order is validly cancelled, we will refund the standard outbound delivery charge. Additional costs for an enhanced or more expensive delivery method are not normally refundable beyond the cost of our standard service.

Faulty, damaged, incorrect or misdescribed goods

Please contact us as soon as reasonably possible if an item is faulty, damaged, incorrect or not as described.

Depending on the circumstances and your statutory rights, you may be entitled to reject the goods, receive a refund, request a repair or replacement, or receive another appropriate remedy.

We may ask for photographs or other reasonable information to help us understand and resolve the problem. This does not limit your statutory rights.

Where a product is confirmed to be faulty, damaged, incorrect or not as described, we will cover reasonable return costs where a return is required.

Exchanges

We do not currently operate a direct exchange service.

If you wish to change the size or colour of an unwanted item, you may return it in accordance with our Returns & Refunds Policy and place a separate new order.

This does not affect your rights where an item is faulty, damaged, incorrect or not as described.

Customer accounts

If customer accounts are available, you are responsible for keeping your login information confidential and for activity carried out through your account.

You agree to provide accurate and current information and to update it where necessary.

Please contact us promptly if you believe someone has accessed your account without permission.

We may suspend or close an account where we reasonably believe it has been used unlawfully, fraudulently, harmfully or in breach of these Terms.

Promotions and gift cards

If we offer discount codes, promotions, gift cards or other special offers, they may be subject to additional conditions, expiry dates, exclusions or usage limits.

Unless stated otherwise, promotional offers cannot be combined or applied retrospectively to orders already placed.

We may amend or withdraw an offer before an order using that offer has been accepted. This will not affect an order already accepted in accordance with the applicable promotion.

Intellectual property

All content on this website and all Ummah Balance designs are owned by or licensed to Ummah Balance Limited unless stated otherwise.

This includes our name, logo, brand identity, product designs, artwork, graphics, images, photographs, illustrations, written content, product descriptions, reflections, slogans and website presentation.

Except where permitted by law, you must not copy, reproduce, trace, imitate, modify, adapt, distribute, publish, display, manufacture, print, sell, license, upload or create derivative works from Ummah Balance content or designs without our prior written permission.

You must not use our name, logo, artwork, designs, product images or written content for commercial purposes, including on clothing, merchandise, marketplaces, websites, advertisements, social media accounts, digital products or print-on-demand platforms, without our written permission.

Purchasing a product gives you ownership of that physical item. It does not transfer any intellectual property rights in the design, artwork, brand or associated content.

Products are sold for personal and domestic use unless we expressly agree otherwise. They must not be reproduced or presented as official Ummah Balance products for resale.

We reserve all rights in our intellectual property and may take action where it is copied, reproduced or used without permission.

Reviews, photographs and other user content

If you submit a review, photograph, testimonial, comment, suggestion or other content, you confirm that you have the right to provide it and that it does not infringe another person’s rights.

Simply tagging Ummah Balance or mentioning us on a platform does not automatically give us permission to reuse your content.

If you expressly agree that we may use content you have provided, you grant us a non-exclusive and royalty-free permission to reproduce, display, edit or publish that content for the purpose agreed with you.

You may ask us to stop using your content in future materials by contacting us, although this may not affect materials already produced or published before your request.

You must not submit content that is unlawful, abusive, threatening, defamatory, misleading, infringing, discriminatory or otherwise harmful.

Third-party services and external links

We use third-party providers to operate parts of our business, including ecommerce, payment processing, fulfilment, delivery, email and website services.

Our use of third-party providers does not remove our responsibilities to you under the contract or applicable consumer law.

Our website may also contain links to external websites that we do not own or control. We are not responsible for the content, availability or privacy practices of those independent websites.

You should review the terms and privacy information of an external website before providing information or making a separate purchase through it.

Accuracy of website information

We aim to keep our website accurate and current, but occasional errors or omissions may occur.

If we discover an error affecting a product, price, availability or order, we may correct it and contact you where necessary.

We will not make a material change to an accepted order without your agreement. If the order cannot be fulfilled as agreed, we will offer an appropriate alternative where available or cancel and refund the affected amount.

Prohibited uses

You must not use our website or services:

  • For an unlawful, fraudulent, harmful or abusive purpose
  • To infringe our intellectual property rights or the rights of another person
  • To copy, scrape, harvest or misuse website content, product data, images or designs
  • To submit false, misleading or inaccurate information
  • To interfere with the security, operation or performance of the website
  • To distribute viruses, malware, spam or harmful code
  • To impersonate another person, business or organisation
  • To gain or attempt to gain unauthorised access to accounts, systems or data
  • To place orders for unauthorised commercial resale

Our responsibility to you

Nothing in these Terms limits or excludes liability where doing so would be unlawful. This includes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any statutory consumer rights that cannot legally be excluded.

We are responsible for foreseeable loss or damage caused by our breach of these Terms or by our failure to use reasonable care and skill.

We are not responsible for loss or damage that was not reasonably foreseeable when the contract was formed, or for loss caused by circumstances that were not the result of our breach or negligence.

Our products are supplied for personal and domestic use. We are not responsible for business losses, loss of profit, loss of revenue, loss of business opportunity or business interruption arising from use of a product for commercial purposes.

Events outside our reasonable control

We are not responsible for delay or failure caused by an event outside our reasonable control, such as severe weather, transport disruption, strikes, supplier interruption, shortages, technical failures, cyber incidents or changes in law.

If such an event affects your order, we will contact you as soon as reasonably possible and take reasonable steps to reduce the effect of the delay.

If there is a substantial delay, or it becomes clear that we cannot fulfil the order, you may have the right to cancel and receive a refund for products that have not been supplied.

Changes to these Terms

We may update these Terms to reflect changes to our business, products, website, suppliers or legal obligations.

The version that applies to an order will normally be the version in force when the order is placed. Changes made afterwards will not retrospectively alter an existing contract unless required by law or agreed with you.

The latest version will be published on this page with the date it was last updated.

Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply.

No waiver

If we delay exercising a right under these Terms, this does not mean that we have waived that right.

Governing law and courts

These Terms and contracts made through our website are governed by the laws of England and Wales.

If you live in Scotland or Northern Ireland, you may also benefit from mandatory consumer protections under the law that applies where you live and may bring proceedings in your local courts.

If you live in England or Wales, proceedings may be brought in the courts of England and Wales.

Nothing in these Terms affects any mandatory rights available to you under applicable consumer law.
